Hierzu wird das Augenmerk maßgeblich auf die zeitlich-funktionale Ausrichtung des einstweiligen Rechtsschutzes generell und der einzelnen Maßnahmen des einstweiligen Rechtsschutzes (Arrest und einstweilige Verfügung) nach der ZPO im Besonderen gelegt. Im Ergebnis der Überlegungen steht ein eigenständiges, zeitlich sowohl die section der Rechtserkenntnis als auch die der Rechtsdurchsetzung umfassendes Verständnis zu den §§ 916 ff. ZPO. Diesem Systemverständnis zum deutschen Zivilprozessrecht wird die Rechtslage in England und Wales unter Geltung der neuen CPR (1998) gegenübergestellt. Hierzu erfolgt zunächst eine Einführung in die Zwangsvollstreckung und die Grundlagen des einstweiligen Rechtsschutzes nach englisch-walisischem Zivilprozessrecht, bevor die Anwendung von interim injunctions in reduction of execution in den Mittelpunkt der Betrachtung gerückt wird. Die abschließende Rechtsvergleichung deckt dabei grundlegende Parallelwertungen ebenso auf wie vollstreckungsverfahrensbedingte Unterschiede.
